
NEW YORK (1010 WINS) -- Two men were sentenced Monday in the 2018 fatal shooting of a 31-year-old man at a Queens bodega, Queens District Attorney Melinda Katz announced.

On March 22, 2018 around 8 p.m., two men, Fabian DeJesus-Garcia and Gamaliel Desiderio-Sanchez, both 32, went into 5 De Mayo Food Market on Roosevelt Avenue.
According to court documents, Desiderio-Sanchez handed DeJesus-Garcia a .32 caliber pistol once inside the bodega. When the victim, 31-year-old Seferino Flores-Pineda arrived, Desiderio-Sanchez engaged him in conversation. As the two talked, DeJesus-Garcia approached the victim from behind and shot him three times in the face and chest.
Flores-Pineda was transferred to a nearby hospital where he later died from his injuries.
“This was an execution in a busy commercial area with the defendants ambushing the victim,” said D.A. Katz. “While one distracted the target, the other walked up from behind and shot him without provocation. My Office will not stand for brazen acts of violence on the streets of Queens.”
Dejesus-Garcia of Queens was found guilty of murder in the second degree, two counts of criminal possession of a weapon and unlawful possession of pistol ammunition after a trial which concluded in March.He was sentenced to 25-years-to-life in prison.
Desiderio-Sanchez of the Bronx pleaded guilty to manslaughter in the first degree also in March. He was sentenced to 18 years in prison followed by five years of post-release supervision.
