'Your Honor, that's some bulls**t' - Alleged Manhattan subway shooter goes on court tirade

NEW YORK (1010 WINS) -- The man accused of shooting a subway passenger during an attempted mugging near Union Square station made quite the scene at a court appearance Wednesday.

Damon Bailey, 38, has been charged with not only the shooting aboard an N train Monday, but two bank robberies as well, including one just minutes before the shooting, according to authorities. He also allegedly robbed a deli in Murray Hill on Sunday.

Monday’s shooting on the northbound N train wounded a 42-year-old man, who was brought to a hospital in stable condition. Police said the victim was on the train just before 5 p.m. when Bailey allegedly took out a gun and demanded his cellphone.

As the victim handed over his phone, the man shot him in the left leg and fled empty-handed as the train was pulling into the Union Square station, police said.

During an appearance in Manhattan federal court Wednesday, Bailey said, “Your Honor, that’s some bulls***t.” as prosecutors presented evidence against him, according to the New York Post.

Assistant U.S. Attorney Jane Chong reportedly said that Bailey admitted to the crimes after being arrested, to which Bailey said, “They made that s–t up … Where they get this s–t from? I did not rob nobody for no cellphone.”

At one point, the judge asked Bailey to be quiet shortly after being ordered to remain detained, the report said.

Just minutes before the N train robbery, police said Bailey walked into a TD Bank at Canal and Lafayette streets and pulled a gun on an employee at the teller counter.

He allegedly told the worker, “I have a gun, give me cash.” The worker then handed $1,100 over.

Police said Bailey was found Tuesday on an R train with three loaded handguns and cash just after robbing his second bank in two days.

“As alleged, this individual, a day after committing a shooting in a subway, walked away from a Manhattan bank with a satchel of cash and three firearms – but thanks to NYPD officers, this crime spree came to an abrupt end,” said NYPD Commissioner Dermot Shea.

Bailey has been charged with two counts of bank robbery, a count of being a felon in possession of firearms, two counts of knowingly using and carrying a firearm during and in relation to a crime of violence and possession of a firearm in furtherance of a crime of violence.
