NEW YORK (1010 WINS) — An off-duty FDNY firefighter was arrested on Sunday just before midnight for driving while intoxicated, according to the NYPD.

Robert Moran, 49, was pulled over around 11:49 p.m. at the corner of Shore Road and Fourth Avenue in Fort Hamilton just off the Shore Parkway.

Police arrested him after he refused to take a breathalyzer test.

He was charged with driving while intoxicated, driving while ability impaired and refusal to take a breath test.

Refusing a breath test results in an automatic traffic infraction charge which incurs a $500 fine and one-year suspension of license. Officers will often perform a blood test at the precinct after an arrest, and the fact that Moran was charged with the lesser charge of driving while ability impaired and the more serious driving while intoxicated could indicate they did just that.

The FDNY did not immediately respond to 1010 WINS’ request for comment.
