NYPD officer sentenced for firing shots in Long Beach ocean: DA

NEW YORK (1010 WINS) – A former NYPD officer from Long Beach was given up to four years of prison time on Thursday for firing several shots with an unauthorized gun into the ocean in Long Beach, Nassau County District Attorney Anne T. Donnelly said.

David Afanador, 41, who has a history of arrests was drinking when the incident happened at the Atlantic Ocean in March 2021.  Long Beach Police Department Officers responded to a call of several shots fired near Franklin Boulevard and Ocean Beach Park. Police saw the defendant, standing with three others, holding an open can of spiked seltzer with a 9mm Beretta pistol, according to prosecutors.

When asked for an ID, Afanador handed his NYPD identification card along with his drivers license. The NYPD ID card was clearly marked “No Firearms.”

At the time, Alfanador was already suspended from the NYPD at the time for putting a Black man in a banned chokehold, according to prosecutors. He was placed later on restricted assignment and was not authorized to carry a gun.

“This defendant knew he could not legally possess a firearm, but still made the decision to drink with friends on a beach and recklessly fire a loaded gun several times into the ocean,” Anne Donnelly, Nassau County District Attorney said. “Afanador’s behavior was foolish, dangerous, and illegal. We hope that his sentence sends a message to anyone thinking about illegally discharging a weapon in Nassau County in the name of fun.”

Afanador pleaded guilty to a charge of criminal possession of a firearm last year and was sentenced Thursday up to four years in prison.
