Police said Elijah Tracey is charged with attempted murder, assault and criminal possession of a weapon for shooting the 40-year-old worker in front of a residential building at 515 West 52nd Street during a Feb. 10 altercation.

According to a criminal complaint obtained by The New York Daily News, Tracey's brother, Andrew, threatened to shoot the apartment windows of the victim’s teenage daughter.

The teen then reportedly called her dad, as Andrew called his brother Elijah for help.

Their verbal dispute spilled onto the street, and Elijah reportedly punched the girlfriend.

Once her father arrived, he reportedly fought with Andrew.

Andrew is then alleged to have gone to his car and pulled a gun out of the trunk.

Elijah reportedly grabbed the gun from Andrew and shot the worker three times, striking him in the head.

Andrew then reportedly stole the victim's car, crashed it nearby and hopped into his brother’s car and took off.

The Daily News reports that Elijah had been awaiting arraignment as of Wednesday evening.

Police said Thursday that no additional individuals have been arrested for this incident at this time.
