
NEW YORK (1010 WINS) -- An off-duty NYPD officer was suspended without pay on Friday after shooting at his girlfriend’s husband while he was off duty.

Kevin Marcial, 49, was driving through Brownsville around 5:50 p.m. when he noticed the husband of the woman he’s been sleeping with following him in his car, the New York Daily News reported.
Marcial fired a shot at the husband’s car near the corner of Sutter and Williams Avenues from his driver side window, an anonymous source told the Daily News.
The shot went wide, and no one was injured. But the husband reported the incident to police soon after and explained the contentious love triangle in the process.
The jilted husband had the correct license plate for Marcial’s personal vehicle, police found a shell casing at the scene and PIX 11 reported reviewing security footage of the shooting.
Despite the evidence, the NYPD has not filed criminal charges against its officer more than a day later.
Police told the Daily News that an investigation is underway.
