The Jackson Heights detective was in his West Babylon home near Fifth Avenue and Ninth Street when he encountered the intruder at around 3:30 a.m. and shot him.

The intruder was not armed, but the officer claims he yelled “I will kill you.”

The officer’s wife and children were asleep during the incident, and did not witness the alleged exchange or the shooting.

The intruder survived and is recovering at a hospital with non-fatal injuries.

The Suffolk County Police Department is investigating the shooting and break-in.
