Alicia Arnone was found dead in her home by her 13-year-old daughter on March 26, and police quickly arrested Andrae Daniels, who Arnone had a restraining order against and family members said had a history of domestic violence against her.

When officers responded a report of the murder just before 10 p.m., they found Arnone’s daughter with her current boyfriend Nile Diakos, 35.

Police dropped the charges against Daniels and released him from custody on Wednesday after receiving phone recordings of Diakos confessing to the murder and text messages in which he implicates himself, NorthJersey.com reported.

Prosecutors’ new theory is that Diakos snuck out of the house after the murder and circled back around after Arnone’s daughter discovered her mothers’ body, according to court documents.

They arrested him Thursday and charged him with murder, possession of a weapon for an unlawful purpose and hindering his own apprehension.
