Newark Fire Captain Carlos A. Rivera, 49, was found unresponsive on Jan. 15 inside Engine 15 Ladder 7 in Newark, the Essex County Prosecutor's Office told NBC New York. A second man, a retired firefighter, was also found unresponsive.

Both were taken to University Hospital, where Rivera was pronounced dead.

Eliasel Baez, of Kearny, was arrested and charged with distribution and causing a drug-induced death.

“Essex County leads the state in drug overdoses," Acting Essex County Prosecutor Theodore Stephens said. "Given those numbers, it is important we fully investigate these cases and charge the perpetrators with strict liability homicide when appropriate."

An obituary for Rivera said he joined the Newark Fire Department in 1995 and was survived by his wife, Rosiane, and daughter, Scarlett.
