NJ mother sues cemetery for losing track of son's burial plot

PENNSAUKEN, N.J. (1010 WINS) — A New Jersey mother is suing the cemetery where her 38-year-old son was buried two years ago after the graveyard allegedly lost track of the burial plot while landscaping.

Ruth Lee-Morris’s son Eugene Morris II died from a blood clot on May 4, 2021 and was buried at Sunset Memorial Park in Pennsauken soon after, according to a lawsuit filed Tuesday that was reviewed by NJ.com.

When Lee-Morris returned on May 25, 2021 after the funeral, she found all temporary grave markers had been pulled up while landscaping work was being carried out.

She asked a nearby gravedigger where her son’s plot was located, and, after calling the office to confirm, he pointed them to a location.

In June 2022, her son’s headstone was placed, but it was allegedly on a different plot than the one the gravedigger had directed her to the previous year.

The suit also claims the gravestone was facing the wrong direction.

Lee-Morris is seeking damages for negligence, emotional distress, breach of contract, fraud and unjust enrichment.

She said that the confusion over the burial plot exacerbated her grief and destroyed her confidence that she was at her son’s grave when visiting the cemetery.

The lawsuit names Harleigh Cemetery Association and Cemetery Development Company, Inc., the owner and manager of the graveyard respectively.
