NY AG files motion to dismiss Trump lawsuit trying to block investigation into company

NEW YORK (1010 WINS) — Attorney General Letitia James took action against former President Donald Trump’s efforts to interfere with her office's continued lawsuit and investigation into the financial dealings of Trump and the Trump Organization.

Last month, Trump filed a lawsuit in federal court against James attempting to stop the investigation into him and his company. On Wednesday, James filed a motion to dismiss Trump’s lawsuit arguing that the lawsuit is a “baseless attempt to forum shop and should be dismissed on both procedural and substantive grounds.”

“This lawsuit is nothing but a baseless and meritless collateral attack by Donald Trump to stop our legal and legitimate investigation into his and the Trump Organization’s financial dealings,” James said in a statement. “In the three years that we have been conducting this investigation, the Trump Organization and its principles have never challenged the legality of the investigation, until now, when Mr. Trump himself was subpoenaed to testify. We will not be deterred by frivolous lawsuits and will continue to follow the facts of this case because no one is above the law.”

The motion to dismiss argues that there are legal doctrines that bar federal courts from hearing cases that could be more efficiently heard in state courts. It also argues that Trump and the Trump Organization have, for three years, acknowledged the legitimacy of the investigation and have since largely complied with it. The motion also said the case should be dismissed for failure to make a claim.

The motion to dismiss is the most recent update in the ongoing legal battle between James and Trump and company. Earlier this month, James’ office subpoenaed Trump and his children. Eric Trump testified to investigators in 2020.
