Food and Wine Festival Vacation Online Giveaway

CONTEST DATES: September 2, 2024 to September 15, 2024

For the Food and Wine Festival Vacation Online Giveaway, enter between 12:00am (ET) on September 2, 2024 and 2:59pm on September 15, 2024 by visiting https://www.audacy.com/b101philly/contests and navigating to the Food and Wine Festival Vacation Online Giveaway contest page, and completing the online entry form. On or about September 15, 2024, ten (10) entries will be randomly selected from all contest entries received and, upon verification eligibility, will receive one (1) Disney Gift Card, valued at $50. In addition one (1) winner will be randomly selected from all entries submitted and, upon verification eligibility, will receive: one (1) vacation package (the “Vacation”). Vacation shall be awarded by Promoter and subject to the restrictions and approximate retail value (“ARV”) outlined below. The Prize Winner may be accompanied by up to three (3) guests (each a “Guest”, collectively “Guests” and together with the Prize Winner, the “Group”). The Vacation Package shall consist of the following:

 A.   Not more than four (4) round trip coach airfare tickets for four (4) persons between the major gateway airport closest to Prize Winner’s residence and the Orlando International Airport (direct flights are not guaranteed). Departure dates to and from the airport are subject to availability;

B. Round trip ground transportation service for up to four (4) persons or voucher(s) for local ground transportation service between Orlando International Airport and the Walt Disney World® Resort (with the means of transportation to be selected by Disney operating in its sole discretion);

C.   Four (4) nights room accommodations consisting of one (1) standard room (with a maximum room occupancy of four (4) persons) at a Walt Disney World® Resort hotel to be selected by Disney in its sole discretion and subject to availability;

D.   Not more than four (4) standard 5-Day Walt Disney World® theme park tickets with Park Hopper® option) each ticket with an expiration date of November 23, 2025 (each, a “Ticket”).

·   Each Ticket currently provides admission to Walt Disney World Theme Parks for five (5) days.

- Reservation requirements are subject to change.

-Tickets are nontransferable and are valid only during specific event dates and hours. Group members must guard Tickets against loss, theft or damage.

-Certain theme parks, resorts, restaurants and other offerings may be modified or unavailable, limited in capacity, and subject to limited availability or closure. Theme park admission and offerings are not guaranteed.

-To visit the theme parks, valid admission is required for the same theme park on the same date for each person in the Group ages 3 and up; 

E.   Not more than one (1) Disney Gift Card(s) to be given to the Prize Winner with a value of Three Hundred and 00/100 United States Dollars (US $300.00).

·   The Disney Gift Card can be used at select participating locations at Walt Disney World® Resort, Disneyland® Resort, Disney Cruise Line, Disney store locations in the U.S., Canada, and Puerto Rico, shopDisney.com, Disney Photo Pass, Adventures by Disney®, Aulani, A Disney Resort & Spa, and Disney’s Beach Resorts. All costs and expenses not expressly stated in the Vacation Package description above are excluded and solely the responsibility of Prize Winner and/or his/her/their guest(s), including but not limited to: Excursions; Travel insurance; Laundry service; Spa treatments; Alcoholic and specialty non-alcoholic beverages (including specialty coffee); Individually charged snacks and treats (including but not limited to movie popcorn, packaged candy, ice cream, gelato, pastries, and bar snacks); Local and long distance telephone calls; Wireless and internet services; Merchandise and souvenirs; and Tips and gratuities not specifically set forth above.

The approximate retail value of the Vacation Package is Eight Thousand Six Hundred and 60/100 United States Dollars (US $8,600.60) (“ARV”). The ARV of the Vacation Package may vary depending on point of departure and fluctuations of rates and airfares (if applicable). If the actual value of the Vacation Package is less than the stated ARV, the difference in the amount will not be awarded. The Group must travel and redeem the Vacation Package no later than November 23, 2025. 

Vacation Package rules should include, but are not limited to: 

-All elements of the Vacation Package (including, without limitation, the theme park tickets) must be used by the Group at the same time during the redemption of the Vacation Package.

-Theme park attractions and entertainment are seasonal and subject to change without notice.

-If the Prize Winner chooses to bring less than the allotted number of guests, the Vacation Package will be awarded in increments suitable for the actual number of participants with no substitute prize or compensation provided to the Prize Winner.

-The Prize Winner and his/her/their guests will be required to execute one or more liability/publicity release forms prior to booking of any travel. Failure to return the executed release forms within the specified time period will result in forfeiture of the Vacation Package.

-Any lost or stolen theme park tickets or travel vouchers will not be replaced.

-Vacation Package and Vacation Package components (including, without limitation, theme park tickets) may not be sold, redeemed for cash, traded, transferred, rescheduled to dates not within the fulfillment period set forth above, used in conjunction with any other promotion or offer or refunded. Vacation Package is not redeemable for cash. Vacation Package components may not be separated. Any unused portion(s) of the Vacation Package will be forfeited.

-Theme parks, attractions and other offerings are subject to availability, closures, change or cancellation without notice or liability. Park admission, offerings and ticket options are not guaranteed. Disney reserves the right to cancel or modify any offering.

Please note the following restrictions:

-Vacation Package components may not be sold, traded, transferred, or refunded. Vacation Package is not redeemable for cash. Vacation Package is non-commissionable. The following are terms and conditions related to the Vacation as they apply to use by the Prize Winner and Guest(s).        

-Vacation Package is for the Prize Winner and up to three (3) guests of the Prize Winner's choosing. Once selected by the Prize Winner, guests cannot be changed without the express consent of Disney, which may be withheld for any reason. If the Prize Winner chooses to bring less than the allotted number of guests, the Vacation Package will be awarded in increments suitable for the actual number of participants with no substitute Vacation Package or compensation provided to the Prize Winner.

-If Vacation Package includes airfare, the Prize Winner and guests must travel together on the same itinerary, and air transportation must be round-trip from/to the Departure Airport (with possible layovers). Disney will determine airline and flight itinerary in its sole discretion. Airline carrier’s regulations and conditions apply to air travel. Airline tickets are nonrefundable, non-transferable, and are not valid for upgrades.

-Actual value of the prize awarded depends on a number of factors, including booking and travel dates and the number of travelers, and therefore may be lower or higher than the estimated value at the time it is fulfilled. If the actual value of the prize is less than the stated estimated value, the difference will not be awarded. The Prize Winner will not receive compensation for any element(s) of the Vacation Package that any participant(s) is unable to use for any reason, and such unused portion(s) of the Vacation Package will be forfeited.

-No refund or compensation will be made in the event of the cancellation or delay of any flight or cruise (as applicable). Disney is not liable, including for any costs or expenses, if any component of the Vacation Package is delayed, postponed or cancelled for any reason and Prize Winner will not be reimbursed, and no substitution will be provided except as in Disney’s sole discretion.

-Any damaged, lost or stolen Disney Gift Card will not be replaced. Disney Gift Card are not redeemable, refundable or exchangeable for cash (except as required by law) and are subject to the following terms: https://www.disneygiftcard.com/terms/us.

-In the event the Prize Winner and/or his/her/their guest(s) engage in behavior that, as determined by Disney in its sole discretion, is obnoxious or threatening, illegal, is intended to annoy, abuse, threaten or harass any other person, or is contrary to Disney’s health and safety protocols, rules or policies in effect at the time of the Vacation Package, Disney reserves the right to terminate the Vacation Package or other applicable experience early, in whole or in part, and send the winner and/or guest(s) home with no further compensation. The Prize Winner acknowledges and agrees to be solely responsible for any actions, claims or liabilities of any member of the group.

-Disney, its parent, related, affiliated, and subsidiary companies and their respective officers, directors, agents, employees and assigns shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or in any way related to the prize, the receipt, use and/or enjoyment of the prize and/or the promotion.

-Federal, state and local taxes, if any, are the sole responsibility of the Prize Winner, who will receive an IRS Form 1099 reflecting the final actual value of any prize valued at six hundred and 00/100 dollars ($600.00) or more.

-Promoter shall have the right, but not the obligation, to make any deductions and withholdings that Promoter deems necessary or desirable under applicable federal, state and local tax laws, rules, regulations, codes or ordinances.
