DA will again seek death penalty in Scott Peterson's case

Prosecutors will again seek the death penalty for Scott Peterson in the murders of his pregnant wife and unborn son nearly 19 years ago.

They made the announcement Friday, even as a county judge considers throwing out his underlying conviction because of a tainted juror. In August, California's State Supreme Court overturned Peterson's 2005 death sentence in a case that attracted worldwide attention. At the time, justices said the trial judge "made a series of clear and significant errors" in jury selection.

He's convicted of dumping the bodies of his wife, 27-year-old Laci, and unborn son, Connor, from his fishing boat into San Francisco Bay on Christmas Eve 2002.

They surfaced months later.

Peterson was eventually arrested after Amber Frey, a massage therapist living in Fresno, told police that they had begun dating a month before his wife's death. She said Peterson had told her his wife was dead.

Peterson’s defense is calling for a completely new court case.

He appeared remotely for the Friday hearing from San Quentin State Prison and didn't speak during the proceedings.

He has maintained his innocence in the case.
