Police shoot suspect with gun at San Jose restaurant after man is shot, killed

San Jose police are conducting an investigation after two shootings occurred near San Jose State University Sunday morning.

At around 2:44 a.m., a man was shot and killed near the intersection of East San Carlos and South Fourth streets. About 30 minutes later, a second shooting occurred less than a block away when an officer shot a suspect at La Victoria Taqueria.

According to police, officers were at the scene of the homicide when they saw people fleeing the restaurant and received a report of a man with a gun. When they arrived at the scene, they found a suspect pointing a handgun at another person. An officer shot the suspect at least one time, but authorities said the injury is not life-threatening.

Both shootings occurred on East San Carlos Street at around 3 a.m., however, police have not revealed if the shootings are related.

Authorities have not yet determined a motive or named a suspect in the first shooting.

Police warned residents to expect street closures in the area as the investigation continues.
