Man who was charged with murder of son now faces child sex crime charges

CLAYTON, Mo. (KMOX) updated 2:20 p.m. Thursday — The St. Louis County man who claims he pulled over to use a payphone — and somebody stole his car with his 9-year-old son inside — is now facing more charges than just the murder of his son. 

The St. Louis County prosecutor's office has filed child sex charges against Dawan Ferguson. He was charged earlier this month in the 2003 disappearance of his son Christian Ferguson, who had a disability. 

Charges announced Thursday include two counts of rape, two of sodomy and one of child molestation. The prosecutor's office says there are two victims.

The sex charges announcement surfaced during a bond hearing Wednesday.

In court, a prosecutor told the judge that one of the victims was "younger than 15" at the time — and had a child as a result.

The prosecutor also shed new light on why Ferguson was charged with murder after 16 years. There are witnesses who are now willing to testify, who before would not, the prosecutor said. 

Sitting in court in a jailhouse beige uniform, Ferguson looked impassive, wearing a gray beard. He had hoped to be released on bond and placed under house arrest to live with his father.

But the prosecutor warned Ferguson might try to move the body — which has never been found — or he might tamper with witnesses. 

Christian's mother Theda Person also spoke, urging the judge to keep Ferguson behind bars.

"He's been making threats all his life," Person said.

"Are you afraid of him?" the judge said.

"Yes, I am," she replied.

The judge ruled against allowing any bond in the case. Ferguson will remain behind bars.
