Circuit Attorney Kim Gardner taken off another McCloskey case

ST. LOUIS, MISSOURI (KMOX) - St. Louis Circuit Attorney Kim Gardner's office has been removed from the Patricia McCloskey case. Judge Michael Stelzer disqualified her Tuesday, following the ruling by Judge Thomas Clark in the Mark McCloskey case.

Gardner had used the high-profile prosecution in her campaign literature, leading the McCloskey's lawyer to object her handing the matter. Both are accused of brandishing weapons at protestors in front of their Central West End home last June.

The Mark McCloskey case still has not seen another prosecutor appointed.

Missouri law requires such an appointment when the chief prosecutor is disqualified. The McCloskeys are accused of unlawful use of a weapon and evidence tampering.

Gov. Mike Parson has said he would likely pardon the couple should they be convicted.
