Court: Woman injured on United Airlines flight can keep nearly $4M awarded by jury

A woman who was injured while boarding a United Airlines flight in south Texas can keep the nearly 4 million dollars awarded to her by a jury.

As a person living with a degenerative spinal condition, Erica Fulton of Florida was confined to a special wheelchair. It didn't slow her down, and in 2008 Fulton decided to fly on United Airlines from Tampa to Houston and then on to Austin to help her son celebrate his birthday.

But the trip between Houston and Austin proved a disaster.

Two United contract employees were supposed to help Fulton get on the airplane and into her seat. But instead of helping, one employee stepped away, the other dropped Fulton and it 'tore up' her shoulder, according to court documents. She needed surgery. Then the airline wrecked her wheelchair.

Fulton sued and won a $3.8 million dollar judgement which United appealed.

But the 5th Circuit court of appeals has rejected all of the airline's claims and refused to lower the award.
