
A federal appeals court has upheld the dismissal of a lawsuit over a fatal Arlington police shooting three years ago.

Court records say O'Shea Terry was killed after trying to drive away from a traffic stop in 2018. The Arlington Police officer who opened fire, Bau Tran, was standing on the running board of Terry's SUV when he began to drive away.
Tran shot Terry to death before falling off the moving vehicle. He was nearly hit.
Terry's estate and the passenger sued the city of Arlington, but the courts say the officer and the city have immunity from civil action.
Tran still faces a charge of criminally negligent homicide.
