
A federal appeals court says the family of Jordan Edwards of Mesquite can push forward with a lawsuit against his convicted killer, former Balch Springs police officer Roy Oliver.
The 5th Circuit US Court of Appeals says former police officer Roy Oliver is not protected by qualified immunity and that he must face a civil trial over the April 2017 shooting.
At the time, 15-year old Jordan Edwards was at a party in Balch Springs when police were called. After officers arrived, a group of teens got into a car and began to drive away, and that's when then officer Edwards opened fire.
The unarmed teen was killed. Oliver testified at his trial that he thought the car was going to hit his partner.
The civil lawsuit against Oliver patterns the criminal case, that lethal force was not necessary and that Oliver should be held liable.
The case now goes back to US district court for further action.
Oliver is currently serving a 15-year prison sentence for the murder of Edwards.
