
A convicted felon who was shot by Dallas Police has died, the Dallas County Medical Examiner’s office said. Kyle Dail, 30 Dallas, was critically wounded during a struggle as officers tried to make an arrest on Thursday night at the LBJ Food Mart in the 13000 block of North Jupiter.
Police initially saw Dail conducting a drug deal on Thursday night, but Dail fled before he could be arrested, said Police Chief Eddie Garcia. However, a short while later, Dail came back to the same store.
Police responded, this time finding Dail in the back of the store. Body camera and store surveillance video show officers, including three-year veteran, officer Thomas Hoffman, approaching Dail from behind, then struggling as he was grabbed by police.
“The suspect started to resist the officers and officers struggled to take him into custody,” said Garcia. “During that struggle, Dail pulled a handgun from his front pants pocket and raised in the air in front of Officer Hoffman’s face. In response to this action, officer Hoffman upholstered his firearm then fired his department-issued weapon, hitting the suspect.”
Garcia says the store video shows Dail transferring the gun from one hand to another before tossing it to another aisle. That’s when the shot was fired.
Court records show around 20 arrests and convictions for crimes that included evading police, possession of marijuana and numerous thefts. Under federal law, it is illegal for a convicted felon to be in possession of a firearm.
Hoffman will be on administrative leave while the incident is reviewed. The Dallas Police Department and the District Attorney’s offices will conduct separate investigations.
