The man jailed in the death of Athena Strand has now been indicted in Wise County.
Tanner Horner was arrested in December after seven-year-old Athena was found dead.
He's been held on unrelated charges but now The Wise County Messenger quotes District Attorney James Stainton, saying "the Wise County Grand Jury has indicted him for capital murder and aggravated kidnapping."
Horner told investigators it was an accident, saying he had run Athena over while making a package delivery to her home.
Horner told police that Athena was not seriously injured but panic set in when she threatened to tell her father Horner had hit her with the truck. Horner then attempted to break Athena's neck and in not succeeding to kill her, he then strangled her with his bare hands, according to the arrest affidavit.
