Richard Acosta is accused of capital murder because police believe he drove his son 14 year old Abel Acosta to and from the convenience store where the victims were shot and killed.

Now, Acosta's lawyer tells a local Dallas newspaper his client did not know his son even had a gun. Attorney Heath Harris says Acosta first went into the store alone to get some medications. When he returned to the vehicle, the boy then went in and when Acosta heard gunfire he ducked out of sight.

Acosta is being held in the Dallas county jail on a $3 million bond.

Meanwhile, Abel Acosta is still on the run. Garland police are pulling out all the stops to find him. They consider him armed and dangerous.
