Richardson man transferred to federal custody on charges related to Capitol riot

A man from Richardson faces four federal charges in connection with the riot at the U.S. Capitol January 6. Garrett Miller, 34, was arrested last Wednesday and transferred from Dallas County to federal custody Friday.

According to the criminal complaint posted online, Miller has been charged with two counts of entering a restricted building without lawful authority and one count each of "violent entry and disorderly conduct on Capitol grounds," "obstructing or impeding any official proceeding," and "certain acts during civil disorder."

The complaint includes screenshots and reports from social media accounts. On January 2, the complaint says Miller posted that he was "about to drive across the country." The following day, he wrote that he would bring, "a grappling hook and rope and a level 3 vest."

On January 11, the complaint says Miller posted a picture of himself at the Capitol. When someone asked if he had gotten in, the complaint says Miller responded, "just wanted to incriminate myself a little lol.”

The complaint also says Miller threatened Congresswoman Alexandria-Ocasio Cortez. The complaint includes a screenshot of a tweet January 6 where she wrote, "Impeach." Miller responded, "Assassinate AOC."

In a separate post, the complaint says Miller referenced the Capitol police officer who shot a woman, writing, "We going to get a hold of [the USCP officer] and hug his neck with a nice rope[.]”

The Associated Press reported Miller was due for a detention hearing in federal court Monday morning.

Miller's lawyer, Clint Broden, told the AP Miller "regrets his actions," calling them a "misguided effort to show his support for former President Trump."

“His social media comments reflect very ill-considered political hyperbole in very divided times and will certainly not be repeated in the future. He looks forward to putting all of this behind him. We are hopeful that, given his family support and regret for his actions, he will be released so that he can resolve the charges against him in a timely fashion," Broden says.
