A member of the Texas Three Percenters today told a jury in Washington D. C. that he and Guy Reffitt of Wylie had planned to disrupt the Electoral College certification. Rocky Hardy says he was armed at the U.S. Capitol riot.

Hardy, the one-time communications director for the Texas Three Percenters, testified under immunity granted to him by the Government. He has not been charged with any crime.

Reffitt is on trial for bringing a firearm to the U.S. Capitol grounds, obstruction of justice, illegally entering the Capitol complex, and obstructing Congress' counting of the 2020 Electoral College votes.

Hardy traveled to Washington with Reffitt, not to take part in a march, but to take action against an election that both men still feel was stolen from President Donald Trump. “Our presence there, they would not certify the vote that day." Hardy said.

Prosecutors say that Reffitt, clad in tactical gear, helped lead the charge up the US Capitol steps, battling with police along the way. Hardy and Reffitt had packed rifles for the trip, believing ANTIFA was going to be a problem, Hardy said. There are no credible reports that ANTIFA took part in the riot at the Capitol. Hardy said neither man took a rifle to the Capitol. Although admitting he was carrying a gun, Hardy said he did not see Reffitt’s gun while he was on the Capitol grounds.

Both men felt it was “better to be tried by a jury of 12 than to be carried by six,” Hardy said.

Hardy’s testimony followed witness Daniel Schwager, who served as counsel to the Senate Secretary. “I was in a state of alarm…we were in a grave situation at that point,” Swager said. “We needed to protect” the ballots, Swager went on to say.

The jury spent hours yesterday listening to the testimony of Reffitt’s son, Jackson Reffitt, who had turned him in to the FBI.

Special Agent Laird Hightower told the jury he was the agent who followed up on Jackson Reffitt’s tip.

As the trial recessed until Monday, federal prosecutors told the court they expect to call three or four more witnesses, including Reffitt’s daughter. Then they expect to rest. The defense has indicated it will not call any witnesses.
