Philadelphia attorney asks to withdraw from election suit, says Trump used him to ‘perpetrate a crime’

PHILADELPHIA (KYW Newsradio) — A lawyer for President Donald Trump’s reelection campaign has asked a Philadelphia federal judge to be removed from an election lawsuit against the city’s Board of Elections, claiming Trump “used the lawyer’s services to perpetrate a crime.”

In the filing, Jerome Marcus said Trump insisted “upon taking action that the lawyer considers repugnant and with the lawyer has a fundamental disagreement.”

The initial lawsuit centered around the request to stop the ballot count and the allegation that poll watchers could not see the count in Philadelphia. Marcus was the attorney who told Judge Paul Diamond, “There’s a non-zero number of people in the room.”

Diamond denied the request but ordered equal access for poll watchers — at a 6-foot distance, due to the coronavirus.

Nothing had been filed in the case since November.

Diamond replied to the filing, saying Marcus needs to show that he notified Trump, and then Trump can respond before the order is granted.

KYW Newsradio has reached out to Marcus for comment but has not yet heard back.
