Grandfather of toddler shot on Lake Shore Drive did not shoot at other car, prosecutors say

CHICAGO (WBBM NEWSRADIO) -- A Cook County judge set bond Thursday at $5,000 for the grandfather of the toddler shot on Lake Shore Drive this week, but prosecutors said they do not believe he fired any gunshots during the road rage incident.

Jushawn Brown, 43, of Englewood, faces gun charges for not having a FOID card or concealed carry license for the 9mm handgun police found on him at the hospital.

Brown got emotional as prosecutors talked of how his grandson, 21-month-old Kayden Swann, was hit in the head when the driver of an SUV fired several shots into Brown’s car.

Prosecutors said Brown was driving with his girlfriend, Swann’s grandmother, and Kayden when an SUV merging into his lane almost struck his car.

According to the Block Club Chicago, Brown pulled over and yelled at the driver of the SUV. The two exchanged words and then the other man produced a firearm and asked Brown “what he wanted to do about it while dangling the firearm at the defendant," prosecutors said.

Brown then picked up and placed his 9mm handgun on his lap and continued driving north on Lake Shore Drive. The SUV driver continued to follow Brown’s family and began shooting at their vehicle, prosecutors said.

One of the bullets shattered the rear window of their vehicle and struck Kayden in the head.

Police said it appeared Brown and the other driver had been shooting at each other over several blocks.

But, police said Tuesday they recovered multiple shell casings from the scene and they were all from the same weapon, which was not Brown's, Block Club Chicago reported.

Once at the hospital, police spoke to Brown’s girlfriend and she told police that Brown had a firearm.

After a pat down, police recovered the gun, which was loaded. Since Brown does not have a valid FOID card or a conceal carry license he was arrested.

Judge Charles Beach said he couldn’t imagine anything worse that what Brown is experiencing before setting his next court date for Wednesday.

Brown must post $500 to bond out of jail. His next court date is scheduled for April 14.

Police are still looking for the other driver.
