NAPERVILLE, Ill.(WBBM NEWSRADIO) -- Naperville is considering a ban on the sale of assault weapons and large-capacity magazines.
The City Attorney Michael DiSanto wrote, in a memo to the council,
“no fundamental right is set forth in the United States Constitution for persons or entities to engage in the commercial sale of assault weapons or large-capacity magazines.”
The council will consider banning more than 100 specific types and brand names of forearms and magazines that hold more than ten rounds of ammunition.
The Naperville Sun reports that private transfers or sales would not be impacted and neither would possession of assault weapons and large capacity magazines bought elsewhere or currently owned.
The public will have an opportunity to weigh in during a city council meeting next Tuesday.
A ban would affect two gun shops and pawn shops licensed to sell firearms.
A draft ordinance defines assault weapons by more than 100 types and brand names.
A ban, if enacted, would include magazines that hold more than ten rounds of ammunition. The matter is on the agenda of the City Council next Tuesday.
