(WBBM NEWSRADIO) -- Joliet police could seize vehicles based on the tint of their windows, if a new ordinance passes the city council next week.

The ordinance would mean that vehicles with a darker tint than is allowable under state law could be seized, even on a first offense.

Councilman Cesar Guerrero is on the City Council committee behind the ordinance stressed that the measure would hew to what the state considers illegal.

But the proposed ordinance doesn't sit well with some residents.  Jerry Hervey said the potential seizure of vehicles is disturbing.

“If somebody has tinted windows, you pull them over, you give them a ticket for it,” he said. “There's no criminality in a tinted window. It's a compliance ticket. That's all it is.”

Hervey also expressed concerns that the measure could lead to racial profiling by police.

Despite the opposition and some lingering questions, the proposal passed a committee and will go before the full city council for a vote on Aug. 15.
