Erie County to allow indoor dining to resume in all restaurants

Establishments are not protected, however, from State Liquor Authority enforcement

Buffalo, NY (WBEN) - After a State Supreme Court Judge ruled that nearly 100 restaurants inside of Erie County's Orange Zone will be able to re-open for indoor dining under yellow zone restrictions, the Erie County Department of Health says all others will be able to do the same.

All restaurants in Erie County will be able to offer indoor dining at 50% capacity, as long as yellow zone measures including a maximum of four people per table and six feet of distance between tables are maintained, according to a statement from the County's Department of Health. Previously it was unknown if restaurants not involved in the lawsuit would be able to offer indoor dining.

The action is only effective as long as NYS Supreme Court Justice Henry Nowak's preliminary injunction is in place. If an appellate court of law should rule differently, the Department of Health states it will follow such new judicial order.

The County however also states that restaurants should be aware this action only applies to ECDOH’s enforcement of cluster zone regulations. It does not apply to enforcement that may be taken against any entity permitted by the New York State Liquor Authority.
