Buffalo, NY (WBEN) A judge has extended his temporary restraining order against Governor Cuomo's orange zones to all restaurants.
Judge Henry Nowak ruled Cuomo's orange zones were "arbitrary, capricious, and an abuse of discretion."
Nowak says Cuomo cannot draw up new orange zones without block by block COVID infection data under the order.
Nowak had ruled on Wednesday restaurants who sued could operate under yellow zone restaurants. Thursday, Erie County said it would allow all restaurants to operate under yellow zone guidelines.
