Marilla, N.Y. (WBEN) - Saying, "We've had enough," Town of Marilla Supervisor Earl Gingerich, Jr. has fired off a letter to the Erie County Department of Health to announce the town will not comply with the newly implemented mask mandate in Erie County.
“Every one of the town officials and even the few residents that were present said that we will not comply," Gingerich told WBEN Friday as he awaited response from Erie County.
Gingerich tells WBEN the mandate, announced Monday as phase one of four in a plan to deal with escalating COVID cases in Erie County and Western New York, was met with staunch opposition in the local business community.
“It was 100 percent agreement that the town would take a stand.”
So, what will happen if the Erie County Department of Health sends its sanitarians into the Marilla business community and tags a business not complying with the masking mandate?
“We will make a strong protest and we will decide as a board whether we will use town resources to help defend that business, said Gingerich.
Why Marilla? Gingerich says the town sits along the border with neighboring Wyoming County where there is no mandate and businesses fear customers will shop elsewhere to avoid a mask mandate or head to nearby Batavia where there is no mandate in place as well.
“We will defend our residents and our businesses for the right for them to decide what is best for them."
