Headless body in a freezer alone won't prove murder

An Upper Ninth Ward individual was found with a dismembered, headless body in a freezer in a bus on their property. Think this is an open and shut case? Not so fast one legal analyst told WWL.

“They are going to need a lot more evidence to either convict or implicate this gentleman in this apparent homicide that happened on his property,” said Tim Meche. “Just because they found a headless body on his property does not necessarily constitute evidence that he murdered her, they’re going to need more.”

Benjamin Beale, who also goes by Kelley Kirkpatrick, was booked on a number of counts including obstruction and drug charges, but not murder, not yet at least. So what comes next in the investigation?

“This is where good lab work is going to come in handy. They are going to have to associate him, personally, with the headless body, and they are going to have to associate him with how that body became that way, they could also use some evidence from witnesses to talk about that,” said Meche. “As long as he keeps his mouth shut they are not going to get anything from him.”

Beale, under the name Kirkpatrick, appeared to have still had a functioning social media page as of Wednesday night. On the page, there are a few pictures that raise eyebrows, including a one-time Facebook profile picture that references the TV show Dexter, a show about a serial killer who dismembers people. Could that come back to haunt Beale?

“Absolutely, positively, anything that anybody puts on social media is evidence, anything and everything, people need to be careful what they do,” said Meche.
