SAN JOSE, Calif. (KNX) – An officer with the San Jose Police Department was put on administrative leave following allegations that he was inebriated while responding to the disappearance of 3-month-old Brandon Cuellar.

NBC Bay Area cited a source close to the investigation who alleged that the officer – who has yet to be named – took a breathalyzer test, which showed he had a blood alcohol level of 0.139.
During a presser Tuesday to address “criminal behavior” within the department, San Jose’s police chief Anthony Mata confirmed an officer was placed on leave for “drinking alcohol on the job” during the search for Cueller, according to KTVU.
Mata also apologized to the Cuellar family during the presser and Assistant Chief Paul Joseph said he would not say how it was discovered the officer had been drinking.
It was reported that both the police department and Santa Clara County District Attorney’s Office are investigating the incident.
