Chick-fil-A sued over chicken nuggets

A mother is suing Chick-fil-A after her teenage son was rushed to hospital after eating the chain's grilled nuggets.

According to a lawsuit filed in New York by Francine Powers, her 17-year-old son, identified only as J.P., has a "life-threatening dairy allergy," and the nuggets he ate on Aug. 13, 2022 apparently contained an undeclared dairy allergen, Insider reported.

The incident happened just days before the restaurant posted a notice informing diners that its grilled nuggets and grilled filet may contain dairy due to a "supplier mishap." The allergen remained in Chick-fil-A nuggets, which were sold at restaurants across the country until October 28, when the supply ran out.

When Powers ordered the nuggets for her son, she informed the server of his allergy and was assured they did not contain dairy, Insider reported. After unwittingly consuming the dairy in the grilled nuggets, the teenager's throat began to close and he started to foam at the mouth, according to the lawsuit. He was taken to the hospital for emergency treatment and has since recovered.

The lawsuit claims Powers called the restaurant when her son began to feel ill but was again reassured the grilled nuggets and waffle fries that she ordered contained no dairy.

"Powers told Insider the 10 days between her son's allergic reaction and Chick-fil-A's announcement were 'horrible' because she feared he could have another undiscovered allergy," the publication wrote. "J.P. also suffered severe emotional distress following the incident, she said. He was attending counseling and was uncomfortable eating at restaurants."

The lawsuit is seeking a jury trial and "substantial damages."

Chick-fil-A has not commented on the lawsuit. A message on the chain's website says it is "happy to inform you that the dairy ingredient has been fully removed from both the Grilled Filets and the Grilled Nuggets. "
