
LOS ANGELES (KNX) – A Los Angeles man filed a class action lawsuit against the makers of Texas Pete hot sauce because the product is made in North Carolina and not Texas.
Philip White who bought a bottle of the hot sauce at Ralph’s in September 2021, accused T.W. Garner Food Company of failing to “act in accordance with a fundamental precept of truth in advertising and fair play in the marketplace.”
The hot sauce’s label, which is pictured in the lawsuit, includes the “lone” star from the Texan flag together with a “lassoing” cowboy.”
“In making his purchase decision, White relief upon the language and images displayed on the front label of the Product, and as the time of purchase understood the Product to be a Texas product,” the complaint said, adding there is “surprisingly nothing Texas” about the product.
The complaint also argued that a hot sauce is only “Texas” if it is made in Texas and uses Texas flavors and ingredients.
T.W. Garner Food said in a statement to Fox 8, “We are aware of the current lawsuit that has been filed against our company regarding the Texas Pete® brand name. We are currently investigating these assertions with our legal counsel to find the clearest and most effective way to respond.”
White is seeking an injunction, as well compensatory and punitive damages from the company.
