Anytime a lawsuit is filed against someone, those involved have to be at least a little nervous about the potential results. However, when the baby featured on Nirvana's 'Nevermind' album cover sued the band back in 2021, many fans figured the Nirvana Baby didn't have much of a chance. Luckily for Nirvana, a judge seemed to agree, dismissing the lawsuit after the Nirvana Baby missed a deadline.
Last year, Nirvana fans were surprised when Spencer Elden, the man who as an infant was featured on the band's most iconic album cover, filed a lawsuit against the band claiming the use of his image was child pornography. Of course, Elden had made a career out of the image, often referring to himself as the "Nirvana Baby," which made many wonder if he had any chance of winning the court case. Nirvana had not commented on the case, until two weeks ago when they when they sought a dismissal of the lawsuit.
Now, a judge had dismissed the case after Elden failed to file an opposition to the defendants' motion to dismiss, according to Variety. Elden will still have a chance to file another lawsuit, though it is unknown at this time if he plans to do so. Looks like the Nirvana Baby may have to go back to offering to jump into fan's pools naked to recreate the album cover instead.
