SAN FRANCISCO (KCBS RADIO) – A civil rights attorney with a national profile is calling for charges against the security guard who killed Banko Brown at a San Francisco Walgreens.

Attorney Ben Crump is speaking out, calling the killing of Brown unjustified. Crump is a nationally recognized trial lawyer who leads the George Floyd family's legal team and represents the family of Trayvon Martin.

His statement comes after the San Francisco District Attorney's Office released security footage of Brown's killing, but opted not to file charges against the guard, citing a claim of self defense.

"There is no way you can define what we saw on that video as self defense," Crump stated.

Crump said this case fits the narrative of excessive use of force. "It follows this lineage of cases of private citizens feeling that they have the right to detain a young Black person," he said.

"There's one particular thing I'm waiting to come in from my examination or inspections and once that happens we will file," said Burris.

Burris has asked the State Attorney General's Office to review the case. "A case like this is very important that there's another look taken place by another prosecutor," he said.

The outside review is supported by Mayor London Breed and San Francisco Police Chief Bill Scott.

SF DA Brooke Jenkins has stated that there is insufficient evidence to support the filing of criminal charges against the security guard.
