
An attorney representing a family whose daughter was allegedly raped and killed in Maryland by an El Salvadoran immigrant is set to file a lawsuit against the Department of Homeland Security.
KNX News’ Pete Demetriou reported that a claim has already been filed against two federal agencies for damages for the 2022 crime. The family’s attorney, Brian Claypool, said agents with DHS and the Department of Health and Human Services failed to do their job in assessing a 16-year-old alleged tattooed MS-13 gang member when he came across the southern border.
“Had DHS done the most simple tasks at the border in southern Texas, then this 16-year-old does not enter this country, does not go to Aberdeen, Maryland, and does not brutally rape and murder Kayla Hamilton,” Claypool said.

Claypool has filed a $100 million claim against DHS and DHHS. He also expects to formally file a federal lawsuit in Maryland in March to seek damages and to force the U.S. government to abide by its rules in securing the border.
