Judge Rules LA DA Jackie Lacey's Husband Should Face Prosecution from CA AG

A judge in the San Fernando Courthouse rules that David Allan Lacey, the husband of Los Angeles County Jackie Lacey, should face prosecution by the State Attorney General Xavier Becerra, not the City Attorney.  

California AG Xavier Becerra filed three misdemeanor charges against David Lacey for assault with a firearm for the March 2 incident.

In August, a judge in San Fernando had pushed back the arraignment of the husband of LA County District Attorney Jackie Lacey.

David Lacey stands accused of pointing a gun at Black Lives Matter protesters at the couple’s home in March.

The attorney for Lacey says he and his client do not believe that the California Attorney General has jurisdiction in his case.

Earlier this summer, David Lacey was charged by the CA AG for allegedly pointing a gun at Black Lives Matter protesters. California Attorney General Xavier Becerra filed three misdemeanor charges on Monday against David Lacey for assault with a firearm for the March 2 incident, according to a US News and World Report story. 

In the past, at least two demonstrators stood outside the courthouse in San Fernando defending the BLM protesters.

The charges were first reported by Politico.

David Lacey allegedly said "I will shoot you" to the "Black Lives Matter" protesters in March one day before the primary election outside the couple's home.

Jackie Lacey released a statement earlier this summer saying ""The events that took place earlier this year have caused my family immense pain."

Meanwhile, BLM LA organizer Melina Abdullah had this to say to KNX 1070 News reporter Claudia Peschiutta. She was one of the people allegedly threatened in March by David Lacey.

"Three misdemeanor counts is not enough. We know that if David Lacey was not who he is, he would be facing felony charges." - @BLMLA's @DocMellyMel, who says she was one of the ppl threatened. Jackie Lacey apologized to the public for her husband before the primary election that month.

“He’s profoundly sorry,” said DA Jackie Lacey of her husband, who allegedly pulled a gun on a protester outside their home. “He meant no one any harm.” ⁦

DA Lacey is in a runoff in November for her third term.

According to an Associated Press story from March, "Black Lives Matter organizers spurned Lacey's apology during a separate news conference. They said they were “traumatized."

Abdullah tweeted about the incident in March:
