(WBBM NEWSRADIO) - Wednesday marked yet another chapter in Cook County sheriff candidate Carmen Navarro Gercone and her ongoing battle to be on the primary ballot.

An Illinois appellate court ruled that Navarro Gercone could not be on the ballot because she does not have the proper qualifications. The court reasoned she is ineligible to run, having never gotten the law enforcement certification that is now required by a provision of a new state law.

This is now the second time Navarro Gercone has been removed from the ballot. It was only 17 days ago that a Cook County judge reinstated her on the ballot.

“Today, my lawyers are filing a motion to the Illinois Supreme Court to overturn a ridiculous and politicized ruling to remove me from the ballot over qualifications,” Navarro Gercone tweeted Thursday morning.

Navarro Gercone, once a top aide but now a challenger to the incumbent Tom Dart, argues that her 26-year tenure in the Cook County Sheriff’s Office, graduation from the Sheriff’s and FBI academies is sufficient.

She believes this dispute has become “politicized.”

“I am going to entrust these facts to the Illinois Supreme Court. However, I have been reminded of the fact that Dart’s former top staffer is now working for the Illinois Supreme Court. Please say a prayer or positive thoughts as we take on the machine at the highest level,” Navarro Gercone said,

The Chicago Board of Elections and Cook County Clerk’s Office told the Tribune that since this ruling came so late, posters will be present at early voting sites, indicating Navarro Gercone has been taken off the ballot and that her votes for now won’t be counted.
