Indiana judge tosses out defense counsel in Delphi double murder case

(WBBM NEWSRADIO) -- The Indiana judge set to hear the double murder case from Delphi, has tossed out a filing seeking her recusal.

Judge Fran Gull surprised attorneys for the accused killer Richard Allen, who’s set to go on trial in January on charges he murdered Abby Williams and Libby German in 2017.

Following some back and forth in chambers between the lawyers and the judge, she announced in court that they were voluntarily withdrawing from the case.

That was news to the attorneys, Bradley Rozzi and Andrew Baldwin, who called it an “ambush of defense counsel.”

The attorneys sought her recusal, alleging she pressured them to withdraw after evidence in the case was leaked.

The judge said the motion was filed in error since the lawyers are no longer on the case.

Now they’ve lawyered up and their attorney said “Judge Gull has an overly broad impression of her authority.”
