(WBBM NEWSRADIO) -- Elk Grove Village is suing to get the FAA to consider more options when deciding how to distribute overnight runway noise at O’Hare as part of the Fly Quiet Program.

Attorney Andrew Barr says the lawsuit filed with the DC appellate court is a way to bring transparency to the environmental review the FAA must conduct.

“The entire process has been in a black box,” Barr said Monday.

Elk Grove Village Mayor Craig Johnson said they didn’t want to sue but feel it’s the only way to get the FAA to consider using more diagonal runways at night when heavy cargo planes are busy taking off while residents are sleeping.

“Whatever Fly Quiet program they come up with we all will live under for decades in the future,” he said.

The FAA tells WBBM Newsradio it does not comment on legal proceedings.
