(WBBM NEWSRADIO) — Rudy Bambic, who unsuccessfully ran for a Republican Committeeman slot in St. John, Ind., could face criminal prosecution for giving away ice cream.

At issue is whether Bambic used an ice cream truck to campaign.

Bambic was seen waving from the truck with a hand-made sign in the window reading: “Free! Free! Ice Cream. Vote Rudy Bambic.”

An election board attorney allegedly told Bambic — before election day — to stop and that he was outside a polling place with the truck on election day.

The Northwest Indiana Times reports members of the Lake County Election Board , which comprises two Republicans and two Democrats, voted 3-to-1 to refer the case to the county prosecutor’s office. Another Democrat abstained.

Buying votes is a low-level felony. Bambic maintained he was not trying to buy votes.

“We were giving ice cream away to kids,” he said.
