Lawsuit challenging Wisconsin’s abortion ban may continue, judge rules

(WBBM NEWSRADIO) — A judge has refused to toss out a lawsuit challenging Wisconsin's 174-year-old abortion ban, which means the case will keep moving toward a final decision in the presidential battleground state.

When the U.S. Supreme Court overturned Roe v. Wade in the summer of 2022, Wisconsin's abortion ban was reactivated.

Republicans across the state and country praised the reversal.  The high court's decision, though, also energized Democratic voters.

Wisconsin Gov. Tony Evers, a Democrat, joined supporters of abortion rights and said this latest ruling to allow a lawsuit challenging the state's abortion ban to continue is “good news and a critical step” toward restoring reproductive rights.

Regardless of how the judge ultimately rules, the case will almost certainly end up in the Wisconsin Supreme Court, which is where Democrats want it.

Liberal judges will control the court with a 4-to-3 majority after Aug. 1, when progressive Janet Protasiewicz — an abortion rights advocate — is sworn in.
