Jussie Smollett asks Illinois high court to review conviction for lying about hate crime

(WBBM NEWSRADIO) — Jussie Smollett’s lawyers have asked the Illinois Supreme Court to review his conviction on felony disorderly conduct charges.

“What should have been a straightforward case has been complicated by the intersection of politics and public outrage” reads the filing.

It noted there was a deferred prosecution agreement, in which Smollett would forfeit his bond and do community service — but would not have to admit guilt to charges that he staged a racist, homophobic attack on himself.

Smollett’s lawyers also raised double-jeopardy questions and said the case threatens to upend all such agreements.

Smollett was tried by a special prosecutor. He was convicted and sentenced to 150 days in jail.

The 41-year-old actor served six and was freed pending his appeal.
