(WBBM NEWSRADIO) — A Geneva father is suing the school district in that Kane County community because he says his autistic son was bullied by students and school officials did nothing.

The federal lawsuit says the bullying started last fall when the boy, 12, was attending Geneva Middle School South.

The student has several disabilities, including autism, and he “does not walk in a normal fashion,” the suit says.

But the child wanted to play football and join the team.

There, the lawsuit says, the boy was subjected to “harassment, bullying (and) mocking,” and that he feared for his safety.

Despite several requests from the boy’s parents, the school did nothing, the lawsuit alleges.

As the Kane County Chronicle first reported, the federal lawsuit claims Geneva Community School Unit 304 violated the Americans with Disabilities Act.

School District 304 officials won’t comment on litigation but says it is committed to maintaining “a safe, supporting and welcoming” environment for all students.
