ROMEOVILLE, Ill. (WBBM NEWSRADIO) -- A wrongful death lawsuit is filed against a Will County Sheriff’s Office employee.

Brenda Nash-Milton filed a federal civil rights lawsuit on behalf of her late brother, Gregory Walker, 65 of Crest Hill.

He was shot and killed by a Will County Sheriff's sniper last May. The lawsuit claims Walker raised his hands high into the air during a peaceful surrender following an incident at Fifth Third Bank in Romeoville.

That's when deputy John Allen shot Walker despite him being unarmed. The wrongful death lawsuit alleges excessive force and willful wanton conduct among other charges.
