Georgia's 2019 ban on abortions will remain blocked after the 11th Circuit Court of Appeals decides to await a decision from the U.S. Supreme Court on a smiliar measure out of Mississippi. The Appeals court heard arguments from both sides of the Georgia law debate on Friday.
"The court's stay means that Georgia's abortion ban remains blocked until further notice from the court. Meanwhile, women will continue to be able to make their own healthcare decisions as U.S. Supreme Court precedent requires," said Sean J. Young, legal director of the ACLU of Georgia.
Earlier Monday Young told Audacy Atlanta's Maria Boynton that the court had been expected to wait on the U.S. Supreme Court's decision on the Mississippi abortion ban. That case is scheduled to be taken up by the high court in December. Mississippi's abortion law, according to Young, is less stringent than the Georgia statute in-that it bans abortions after 15 weeks of pregnancy, compared to 6 weeks in Georgia.
Georgia's anti-abortion law is inactive. A judge ruled in July 2020 that it was unconstitutional. Georgia Governor Brian Kemp had appealed the decision. In reacting to Monday's court announcement, Kemp's office said he's confident the state will ultimately prevailed.
