Jerson Acosta-Batista is charged with criminally negligent homicide, two counts of attempted robbery, weapons possession, hindering prosecution and tampering with evidence for the Oct. 3, 2019, killing of Alberto Martinez in Washington Heights.

Acosta-Batista, 22, was arrested on Oct. 1 at Newark Liberty International Airport after arriving on a flight from the Dominican Republic, the Daily News reported. He was extradited from New Jersey on Wednesday.

Police said Martinez was shot around 12:38 a.m. in front of 501 West 168th St., about a block from his apartment. Martinez was taken to Columbia Presbyterian Medical Center, where he was pronounced dead.

The shooter then reportedly fled the scene on W. 168th St. in a getaway car in a getaway car driven by an accomplice.

It wasn't immediately clear if Acosta-Batista was the killer or driver.

Cops told the outlet that Martinez had 15 arrests on his record, including for gang assault and weapons possession, and was a member of the Trinitarios gang, a Dominican American criminal organization founded by Dominicans in the city in the 1990s.

The other suspect remains at large.
