Man pleads guilty to homicide for killing 8-year-old son in Queens drunken car crash

NEW YORK (1010 WINS) — A 37-year-old man pleaded guilty to aggravated vehicular homicide on Wednesday for being under the influence during a Queens car crash that killed his 8-year-old son in 2020, according to the Queens District Attorney’s Office.

Victor Mitchell was driving with his son in the car around  6:50 a.m. on Aug. 16, 2020, when he crashed into a telephone pole at the intersection of Seagirt Boulevard and Beach Street in Far Rockaway.

A breathalyzer test showed Mitchell had a blood alcohol content of .118, above the legal limit of .08. A Draeger oral drug test also tested positive for THC.

Emergency responders rushed Mitchell’s son to a nearby hospital, where he underwent emergency surgery. He succumbed to his injuries the next day.

“This man’s recklessness led to the tragic death of his young son and could have harmed others on the road,” said Queens DA Melinda Katz. “There are very few things more selfish than getting behind the wheel and driving under the influence.”

The judge responsible for sentencing on July 28 is expected to sentence Mitchell to four to 12 years in prison, according to Katz.
